1. Acceptance of Terms

Welcome to the services provided by BLOOMVERSE INTERACTIVE PTE. LTD. ("Bloomverse," "Company," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Player," or "you") and Bloomverse regarding your access to and use of our website (bloomverseinteractive.com), mobile games, web games, and related services (collectively, the "Services").

1.1 Agreement to Terms

By downloading, installing, accessing, or using our Services, or by clicking "Accept" or "Start Game" where this option is made available, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services and must uninstall our applications immediately.

1.2 Eligibility

You represent and warrant that you are at least 12 years of age (or the minimum age of digital consent in your jurisdiction). If you are between the ages of 12 and 18 (or the age of majority in your jurisdiction), you represent that your legal guardian has reviewed and agreed to these Terms and has consented to your use of the Services.

1.3 Changes to Terms

Bloomverse reserves the right, at its sole discretion, to modify, amend, add, or remove portions of these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or within the Game. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

2. Accounts & Security

2.1 Account Registration

To access certain features of the Services, you may be required to register an account ("Account"). You may also log in via third-party social networking services (e.g., Facebook, Google, Apple Game Center). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for maintaining the confidentiality of your Account credentials (username and password) and for all activities that occur under your Account. You agree not to sell, rent, lease, share, or transfer your Account to anyone else. You must notify Bloomverse immediately of any unauthorized use of your Account or any other breach of security.

2.3 Ownership of Account

NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF BLOOMVERSE. Bloomverse does not recognize the transfer of Accounts. You may not purchase, sell, gift, or trade any Account, and any such attempt shall be null and void.

3. License & Restrictions

3.1 Limited License

Subject to your compliance with these Terms, Bloomverse grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to download, install, and use the Services solely for your personal, non-commercial entertainment purposes.

3.2 License Restrictions

Except as expressly permitted by these Terms or applicable law, you may not:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Services;
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices incorporated in or accompanying the Services;
• Use the Services for any commercial purpose or for the benefit of any third party, including but not limited to use at a cyber cafe, computer gaming center, or any other location-based site;
• Use any unauthorized third-party software (including but not limited to hacks, mods, bots, scripts, trainers) that intercepts, mines, or otherwise collects information from or through the Services;
• Make the Services available over a network where it could be used by multiple users simultaneously, unless the Service itself provides such functionality.

4. Intellectual Property

The Services and all content, features, and functionality thereof (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, game titles such as "Stellar Bloom," "Pixel Garden," "Cyber Conquest," computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information) are owned by Bloomverse, its licensors, or other providers of such material and are protected by Singapore and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Bloomverse name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Bloomverse or its affiliates or licensors. You must not use such marks without the prior written permission of Bloomverse.

5. Prohibited Conduct

You agree that you will not engage in any of the following behaviors while using the Services. Violation of this section may result in the suspension or permanent banning of your Account:

1. Cheating & Hacking: Using, creating, distributing, or making available to the public any cheats, automation software (bots), hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Services, any Game file, or any Game experience.
2. Disruptive Behavior: Disrupting or overloading any computer or server used to offer or support the Services, including assisting in or encouraging any type of cyber attack (e.g., DoS attack).
3. Toxic Behavior: Harassing, threatening, bullying, embarrassing, or doing anything else to another player that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc.
4. Impersonation: Impersonating any person or entity, including, but not limited to, a Bloomverse employee, official, or forum moderator, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
5. Exploitation: Exploiting, distributing, or publicly informing other members of any game error, miscue, or bug which gives an unintended advantage.
6. Real Money Trading (RMT): Buying, selling, or trading any Virtual Currency or Virtual Items for "real" money or trading them outside of the Service without Bloomverse's express written authorization.

6. Virtual Goods & Currency

6.1 No Ownership Rights

The Services may include virtual currency (e.g., "Gems," "Gold," "Credits") and virtual items (e.g., skins, characters, equipment) (collectively, "Virtual Goods"). You acknowledge and agree that, whether obtained through gameplay or purchased with "real world" money, you do not own any Virtual Goods. You are granted a limited, non-transferable, revocable license to use these Virtual Goods within the Services.

6.2 No Monetary Value

Virtual Goods have no monetary value. They cannot be redeemed for "real world" money (e.g., USD, SGD, EUR), goods, or any other item of monetary value from Bloomverse or any other party at any time. Bloomverse strictly prohibits and does not recognize any purported transfers of Virtual Goods executed outside of the Services, or the purported sale, gift, or trade in the "real world" of anything that appears or originates in the Services.

6.3 Management & Forfeiture

Bloomverse reserves the right to control, regulate, change, or remove any Virtual Goods without any liability to you. If your Account is terminated or suspended for any reason, all Virtual Goods associated with your Account will be forfeited, and you will not be entitled to any refund or compensation.

7. Payments & Refunds

7.1 Payment Processing

You may obtain a license to use Virtual Goods by paying "real world" money through third-party platforms (e.g., Apple App Store, Google Play Store, Steam). All purchases are processed by these third-party platforms, and you must agree to their terms and conditions. Bloomverse does not directly process your credit card information.

7.2 All Sales Final

EXCEPT AS REQUIRED BY APPLICABLE LAW, ALL PURCHASES MADE THROUGH THE SERVICES ARE FINAL AND NON-REFUNDABLE. Once a transaction is complete, Bloomverse has no obligation to provide a refund, regardless of whether the purchase was voluntary or the result of unauthorized account access. If you have a dispute regarding a purchase made through Apple or Google, please contact the platform directly.

7.3 Price Changes

Bloomverse reserves the right to change the price of the Services or Virtual Goods at any time without notice. We do not offer price protection or refunds in the event of a price drop or promotional offering.

8. User Generated Content (UGC)

The Services may allow you to create, upload, or publish content (e.g., chat messages, custom maps, character builds) (collectively, "User Content").

• License Grant: You retain ownership of your User Content. However, by uploading or publishing User Content, you grant Bloomverse a worldwide, perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content.
• Responsibility: You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to submit the content and that it does not infringe any third-party rights or violate applicable laws.

9. Updates & Termination

9.1 Patches & Updates

Bloomverse may need to update the Services, for example, to fix bugs, enhance features, or rebalance gameplay. These updates may result in setbacks within the game world or affect characters, virtual goods, or other data. You agree that Bloomverse may install such updates automatically without notice.

9.2 Termination by Company

Bloomverse reserves the right to stop offering and/or supporting the Services or a particular game or part of the Services at any time, at which point your license to use the Services or a part thereof will be automatically terminated. In such event, Bloomverse shall not be required to provide refunds, benefits, or other compensation to users.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLOOMVERSE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL BLOOMVERSE'S AGGREGATE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO BLOOMVERSE IN THE SIX (6) MONTHS PRIOR TO THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNT, YOUR SOLE REMEDY IS TO STOP USING THE SERVICES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bloomverse and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; or (c) your violation of these Terms.

13. Dispute Resolution & Governing Law

13.1 Governing Law

These Terms and any action related thereto will be governed by the laws of the Republic of Singapore without regard to its conflict of laws provisions. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly disclaimed.

13.2 Exclusive Jurisdiction

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by the exclusive jurisdiction of the Courts of Singapore.

13.3 Class Action Waiver

YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. YOU WILL NOT SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, OR IN ANY PROCEEDING IN WHICH YOU ACT OR PROPOSE TO ACT IN A REPRESENTATIVE CAPACITY.

14. General Provisions

• Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
• No Waiver: Bloomverse's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Bloomverse regarding the Services.
• Force Majeure: Bloomverse shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control (e.g., acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials).
